RECORD GROUP 8: ENVIRONMENTAL PROTECTION

ADMINISTRATIVE HISTORY
In 1972, the Department of Environmental Protection (DEP) was created in the course of a reorganization of the Montgomery County government which combined the former Department of Inspection and Licenses, the Division of Environmental Health (of the Health Department), and the Division of Solid Waste Management (of the Department of Public Works) into a single agency. The mission of the DEP is to promote a healthful, safe, and beneficial environment through planning and implementing programs and services which preserve and enhance the quality of the natural environment, conserve energy, and ensure compliance with environmental laws and regulations. The Department was originally organized into six divisions, the Division of Housing and Animal Control, the Division of Solid Waste Management, the Division of Resource Protection, the Division of Construction Codes Enforcement, the Division of Public Facilities, and the Division of Research and Monitoring. The Department has undergone several reorganizations and is now divided into three divisions: Development Services and Regulation; Water Resources Management; and Office of Environmental Policy and Compliance.

PROCESSING PROCEDURES
General processing procedures consisted of discarding duplicates, unnecessary binders, and routine transmittals. Oversized documents and photographs were removed from the original location in their assigned series and placed in separate containers. Separation sheets were inserted in the original location within the folder to indicate the new location of any records placed elsewhere.
Records in folders were arranged, unless otherwise indicated, in forward chronological order, with undated records appearing at the end of the folder.
PROVENANCE
The collection was culled from various accessions of printed material, and from material transferred from Poolesville and Rockville Libraries.
SCOPE AND CONTENT NOTE
The printed material of the Department of Environmental Protection comprises 10.5 cubic feet of reports, studies, and permit applications documenting County plans, projects, and programs for the protection of the environment, solid waste disposal, generating and conserving energy, and resource recovery.
Appendix A, located at the end of this finding aid, contains three lists of some of the materials that were transferred to the Archives.

SERIES DESCRIPTIONS
Series I: Department of Environmental Protection, 1972-1997 (8 cu.ft.)
This series contains material not specifically created by or for an individual DEP division, or for projects and programs whose scope spanned two or more divisions or another County department. Most of these records were assembled by topic in order to aid researchers.
The series is divided into six subseries: Department Printed Material, Dickerson, Oaks Landfill, Rock Run, Resource Recovery, and Solid Waste Task Force.
All subseries are arranged in chronological order and then alphabetically within each year unless otherwise noted.
Subseries 1: Department Printed Material, 1972-1997 (1.5 cu.ft.)
Materials in this subseries include studies, plans, and reports relating to the site selection, design and environmental impact of landfills, an incinerator, resource recovery facilities, and a solid waste processing facility. Specific topics include Travilah Quarry, a proposed medical and pathological waste incinerator, Oaks Landfill, and reports from Phases I and II of a 1985-1986 Solid Waste Management Study.
Subseries 2: Dickerson, 1972-1995 (5 cu.ft.)
The DEP has a long history of interest in the Dickerson area, first because it is the site of a Potomac Electric Power Company (PEPCO) power plant, later as the proposed location of an advanced wastewater treatment plant, and then as the centerpiece of the County's solid waste management plan, projected to house both a resource recovery facility and a County landfill. The earlier records in this subseries relate primarily to the PEPCO power plant, and contain exhibits, testimony, and other closing documents submitted to the Public Service Commission of Maryland in 1989 regarding PEPCO's application to build a staged coal gasification combined cycle power plant at Station H in Dickerson. The subseries also contains reports from 1980 on the proposed sewage sludge composting and wastewater treatment facility, and agreements, applications, and monitoring standards and reports relating to the proposed Dickerson landfill and resource recovery facility during the 1990s. Montgomery County joined the Northeast Maryland Waste Disposal Authority, which was created by the State to assist participating Maryland political subdivisions to develop systems for the disposal of solid waste and the recovery of energy and other resources. The Authority contracted with Ogden Martin Systems of Montgomery Inc. to design, construct, equip, start-up, test, and operate a resource recovery facility at Dickerson, to undertake transfer station improvements, and maintain and operate rail transport facilities and equipment for the transfer of solid waste. These records document the formal relationship between the County, the Authority, and Ogden Martin Systems, and include permit applications, closing documents, and operating and maintenance plans.
Maps were transferred to Record Group 19, Audiovisual Materials. Responsibility for this function was transferred to the Division of Solid Waste Services of the Department of Public Works and Transportation in July 1995.
Subseries 3: Oaks Landfill, 1978-1988 (0.5 cu.ft.)
Oaks Landfill, located approximately one mile southeast of the town of Laytonsville, opened in 1982 despite fierce opposition from the local community. The previous landfill on the Gude Southlawn tract in Gaithersburg had been in operation since 1962, and had rapidly reached its capacity after the County's incinerator was closed in 1975 due to mechanical problems and the passage of more stringent air pollution laws. After a prolonged and extensive selection process, the County chose the Laytonsville site because its geologic conditions promised to provide the greatest protection to the groundwater, the community, and the environment in general. Traffic was minimized by the construction of a transfer station at Shady Grove Road, and the County determined to pursue recycling and resource recovery alternatives in order to minimize the need to landfill refuse. In the meantime, the County vigorously monitored the groundwater quality and other potential environmental concerns, and operated the landfill using methods designed to minimize its impact on the surroundings.
Reports in this subseries include studies undertaken prior to the opening on behalf of landfill opponents, and monitoring reports once it was in operation. The subseries also contains a 1982 informational brochure for the public that provides background information for the county's solid waste management program and the selection of the Oaks site, and addresses as well related issues of concern to County residents.
Subseries 4: Rock Run, 1979-1982 (6 folders)
Reports in this subseries relate to the Rock Run Advanced Wastewater Treatment (AWT) facility proposed by the County to meet the expanded needs caused by the County's rapid growth. The Rock Run plant, to be built and operated by the Washington Suburban Sanitary Commission (WSSC) and located in the Potomac area, was designed to ease the burden on the District of Columbia Wastewater Treatment Facility at Blue Plains by withdrawing water from the Dulles Interceptor, a major wastewater conveyance line, treating it, and discharging it into the Potomac River at Little Falls Branch.
Items include reports of interagency task forces appointed by the County and informational material created for public consumption.
Subseries 5: Resource Recovery, 1979-1992 (0.75 cu.ft.)
This subseries documents the County's commitment to resource recovery as a cornerstone of its solid waste management program. Records include feasibility studies and portions of the 1982 request for proposals.
Subseries 6: Solid Waste Task Force, 1992 (0.25 cu.ft.)
This subseries contains the public work session data, decision materials, draft legislation and regulations, and comparative cost scenarios developed by the Solid Waste Task Force staff, and includes a draft County policy on waste source reduction, an issue paper from the financial advisor regarding funding options, a memorandum regarding status of competitive procurement, legal opinions and information regarding risk and liability, environmental impact data, and a letter containing Solid Waste Advisory Committee recommendations with attached recycling program information. The volume entitled financial spreadsheets includes projections of waste tonnage generation and composition through the year 2020; detailed program, cost, and component recovery information regarding expanded recycling efforts; and cost scenarios for each of three disposal options. The final volume contains the handouts and summaries of the Solid Waste Task Force Public Work Sessions. The subseries also contains draft regulations for mandatory single family, multi-family, and commercial recycling requirements; draft legislation which creates a "systems benefits charge" to supplement the tip fee and allow the use of volume based pricing; a draft ten-year plan amendment which authorizes a County-wide collection and disposal district; and draft ten-year plan amendments for each of the alternatives.
Series II: Office of Environmental and Energy Planning, 1980-1981 (3 folders)
This office was concerned with energy conservation and recovery. The reports in this series include a 1980 survey of energy use in the County, a grant application for a feasibility study for methane recovery and utilization at the Gude Landfill, and a 1981 manual for residential energy saver cooperatives.

Series III: Office of Environmental Planning, 1974-1978, 1986 (1.25 cu.ft.)
Nearly all of the reports in this series relate to site selection and evaluation for sanitary landfills, with the bulk consisting of a six volume site selection and evaluation study performed by Dames and Moore in 1978. The series also contains a 1978 study of sewage treatment facility and sewerage needs for the County, and the executive summary for a 1986 solid waste management study.

Series IV: Office of Environmental Construction, 1979-1980 (0.25 cu.ft.)
This series contains reports relating to the use of Rockville Quarry as a solid waste balefill, and includes a preliminary site investigation and feasibility study. The series also contains a 1980 design report for the solid waste transfer station that was planned to function as a collection point for solid waste in order to minimize traffic to the landfill site.

Series V: Pollution Control, 1972-1981 (0.25 cu.ft.)
This series contains the printed material of the Water Supply and Pollution Control Section and the Division of Pollution Control. It includes reports on the water quality of County streams from December 1969 to July 1971, and from 1977 to 1980; an environmental report on asbestos; and a 1981 manual for nonstructural damage.

Series VI: Division of Resource Protection, 1972-1982 (0.25 cu.ft.)
The Division of Resource Protection was one of the original six divisions of the DEP when it was created in 1972. The Division was concerned chiefly with the conservation and protection of water through the management of storm and waste water as well as through the disposal of the sludge generated by these processes. It was also responsible for the monitoring and enforcement of air quality and noise controls.
Materials in this series include air quality reports from 1969 to 1977, water quality reports for 1974 and 1976, and other environmental studies.

Series VII: Division of Solid Waste Management, 1972-1978 (0.5 cu.ft.)
The Division of Solid Waste Management Services was one of the original six divisions of the DEP when it was created in 1972 while the County was in the midst of a solid waste crisis. Rapid growth and the closing of the County's incinerator combined to cause the Gude Landfill to reach its capacity prematurely, and the County determined to focus on recycling and resource recovery in the disposition of solid waste. The series contains environmental reports on the Gude Landfill, a 1978 landfill design and operating plan for Site S-55B in Laytonsville, and studies and reports relating to the first Ten Year Solid Waste Management Plan, which was adopted in 1974.
